They dont "make up" the numbers on the window, they're regulated by law to put them there, and the tests used to generate them are defined by the EPA.
In 2008, the EPA changed their testing procedure to produce numbers that are closer to real-world driving scenarios. Prior to that, EPA ratings were typically about (gasp!) 20% higher than what the average driver could achieve in the real world.
Plus, the people commenting on that story on the usatoday site are correct to question how she gets to $122,112 in losses on a $25k car. EPA was 51mpg for that car, and 20% less than that is 41mpg.
For sake of argument, I'll set the resale value of the car to $0, which we all know is fundamentally untrue, but roll with it.
$122,112 - $25,000 = $97,112.
Now lets take away $10k for TWO non-warranty battery replacements (over pricing, but anyway)
$97,112 - $10,000 = $87,112.
Now; Let's set the hypothetical life of the car at 1,000,000mi.
$97,560 - $78,402 = $19,158 in extra fuel costs due to a 20% reduction in FE over 1,000,000mi
$87,112 - $19,158 = $67,154 that is totally unaccounted for.
More than 50% of her total claim cannot be accounted for, even being extremely generous to ALL of her arguments.
Note: 1,000,000mi takes 1.9 years @ 60mph, running 24 hours a day, 365 days a year.

Never mind that when you buy a car, you expect to pay for repairs and maintenance to it, and when you buy a hybrid, one of the things you have to repair and maintain is the battery, which, like any other battery you buy, eventually wears out.
You don't sue Duracell because your TV remote doesn't work as well when the batteries are wearing out, you just replace the batteries and move on with life.

ps i have a 05 HCH, and that woman doesn't understand anything about the car i bet. I can't believe she only was getting around 40mpg. i got over 40mpg on my way to work today and it was 9° out. no auto stop, snow tires, and 7 miles of stop and go city driving. plus i wasn't hypermiling because i just wanted to get to work because it was to cold to waste time sitting in the car.

My wife owned an 03 Civic Hybird and now owns an 05 Civic Hybird and she is joining the class action Lawsuite. She expects to get around $200 for each car she owned. She only gets 41mpg in her 05 right now. $400 is enough for a new set of tires. LOL
Well she gave up her "lawyers license" a while back. She must have been the lawyer that represented the guy who was suing Budweiser because he was wakeing up with ugly women after drinking at the bar.
The sticker on the EPA mileage definately says....(Mileage will vary due to driver...Etc.)

No, I'm not joking, She received 2 letters in the mail asking her to join the Class Action Lawsuit against Honda. All she has to do is sign her name and she is in. And no, she is not the Woman sueing in California. I think she just wants the $400 for new tires.
