Seriously. If you have your foot on the brake, your lights should stay on. If you've let off the brakes, they should go off, but NOT for any other reason. blinking doesn't say,"look at me, I'm braking." It says that you are lightly pressing on the brakes and crossing back and forth over that threshold where the brake light switch is activating.
I think those blinking modules should be illegal, and if I were to ever rear end anyone with one, I'd definitely take them to court. To me that is the same as driving with non-functioning brake lights.
Brake lights are about communication, and this affects the way they communicate. Whether conciously or subconciously drivers interpret brake lights based on what they've seen cars do in the past.
If you were to get rear ended and wonder why it happened even though you have this 'safer' setup, I'd say it's like ordering at a restaurant speaking Swahili, then wondering why the waiter won't bring you your food even though you've politely explained at length exactly what you want. The waiter has an opportunity to say he doesn't understand and request you speak his language. I am now exercising my opportunity to do the same: Please don't run that blinking unit!
