What gives with the proposed "settlement" for the legal actions brought for less than advertised gas mileage for 2003-2009 HCHs? Seems to range from $100 to $500/$1000 rebates for future Honda purchases to extending the "original" battery warranty by 12 mos/12000 miles whichever comes first.
I got a letter today. The way I read it, and it gets kind of hairy, is thus:

- There is a settlement class and a sub-class. The class is purchasers of model year 2003-2009 HCH. The sub-class is purchasers of model year 2006-2008 HCH.

- There is a cash payment of $100 and two rebate options, A and B.

- Option A rebate is $1000 towards the purchase or lease of a new Honda. Option A requires you sell or trade in the old HCH and is NON-transferable.

- Option B is $500 towards the purchase or lease of a new Honda. Option B does NOT require selling the old HCH and IS transferable.

- The entire class can claim the $100 payment if they sign off, under penalty of perjury for lying, that they are dissatisfied with the mileage they got on their HCH.

- The sub class can claim an additional $100 ($200 total) under the same conditions.

- The entire class can claim either the Option A or Option B rebates after signing off.

- The sub class can claim an additional Option B ONLY ($1000 total) after signing off.

Like I said, kinda convoluted. I will not be filing for the $100 dollars on my 2003 HCH because I have been more than satisfied with the mileage.

JohnVirginia: I'm kinda curious if you ever followed up with a BetterBattery or if you're still abusing the old one like me

Local paper had an AP article by Linda Deutsch on lawsuit by Heather Peters of Torrance, Calif. She evidently has declined the proposed settlement offered and filed a small-claims action.

Yep...still "abusing" the old battery...waiting for my ship to come in or the dreaded CEL code that shuts the DC-DC converter down killing the 12V charging.

Yeah I saw it. Posts have been popping up here and at GH about this. Found it kind of a coincidence that the these posts pop up on the same day I get my letter? Regardless, apparently Honda didn't hit a home run with at least the early Gen2 HCH. I even had a parts guy at the dealership let slip they were changing a ton of batteries on the second generations. This was before it really became public. And HCH wouldn't settle the case if something wasn't going on. Hopefully the disappointed can get at least some relief. I am glad my 03 worked out great.

Yeah me too. But I'm coming up on 255,000 miles and still aiming for 300K. I need to get through one more NYS inspection in July and I figure I should turn 300K early next year if she holds up. With the car throwing multiple codes (P0420, P1420, P1457, but still running fine), no AC, RF window stuck up and blows fuses, salt starting to take it's toll and numerous clunks and groans it just isn't worth throwing a new battery in at this point.

But I'm keeping an eye on craigslist for a low mileage Gen1 MT HCH to replace her! Depending on price and mileage, that one will get a BetterBattery.

Cheers....

Evening news reported the lady (lawyer) won her small claims case against Honda, thousands vice $200 offered in settlement. Now they are predicting Honda will roll out the big guns (stable of lawyers) on appeal.
