Default Rear End Accident info needed

Hi all,
My brother was rear ended (North Fork, Long Island NY) in his green 2000 Insight. It is totaled. He got thrown from the drivers seat to the passengers seat, and he had his seat belt on. Medically - ruptured aorta, broken/cracked ribs, chest cavity bleeding, broken vertabrae, doing ok now, a week later after couple operations.
He is suing driver that hit him and needs any info that people have about being rear ended. He found out that the air bags do not work in a rear end accident, only front where the sensor is and he thinks that the seat belt retractor mal functioned or is not supposed to tighten in a rear end.
So any info would be appreciated...
