You did report your concerns with battery performance to Honda at 78000 miles,(still in warranty period) that must be in your favour for the warranty, as is the discrepancy in odometer readings. Do you have records of the report and conclusion?
The 25% of $3000 is $750, does that sum include the labour charge of installation of the Honda pack?
If the final bill is $750 and you have a 3 year warranty, I think you have still have a reasonable deal on the table without the risks of losing a legal claim
